But oddly enough, the judge in this case would be on stronger footing because it's a civil, not criminal case. Courts have been able to appoint amici in the past to argue civil actions on behalf of the government. But those were done because the government did not had the technical knowledge to argue the case and was also done with the government's consent.
The judge should refuse to allow the government to dismiss the case and appoint an amicus
One hopes, but unlikely. The Court had already denied an intervening party claim by a student group to join the case against Yale.
Crazy thing is, Yale didn't even have to file an answer. They ran out the clock until Biden DOJ dismissed.
