Well... now I'm a bit more informed ... so I know some of what he was thinking:

Roberts concurred with the Judgment of the majority but not their opinions nor those of the three dissenting justices.

He has "doubts" as opposed to the "certainty[ies]" of the other 8.

Pretty typical stuff from Roberts. As others have observed about Roberts: "By striving so conspicuously to depoliticize the Supreme Court, he has brought about the very thing he hoped to prevent: No one has done more to politicize the court than the chief justice."

So, can this be called a 6-3 decision?

Or is it a 5+1(?) to 3?

It appears not to be a 5-4.

The legality of abortion moves to the states where it should have been to start with.

The Wall Street Journal just announced it and said “Supreme Court overturns Roe v Wade, eliminates constitutional right to abortion “. I think we have dark days ahead of us. BLM like riots. Because people do believe that abortion was a constitutional right when in reality it was not - and they want to kill their babies.

No one said that the media and the the American people are well informed. I believe you are correct, violence is pending...and it will be reported as the rioters have justify grievances, they are mostly peaceful and the Dems will bail them out IF any of them get arrested.

This ruling was overturned due to a case in Mississippi, Dobbs vs. Jackson Women's Health went to the Supreme Court. Abortion decision now is left up to the states, which it should have been in the first place, due to state's rights clause in our Constitution. What Mississippi proposed is that abortion is legal until 4 months when the baby's heartbeat can be heard and can live outside the womb on its own. Not everyone will like this, but one thing about it is that it IS a compromise between the pro vs. anti-abortion sides and I hope it's something that at least most folks can live with. I know there are those who say NO ABORTION WHATSOEVER but I do think that if a 14 y.o. is raped and becomes pregnant, for example, she should be able to terminate the pregnancy instead of having a lifelong reminder of a horrifying event that will keep her in PTSD the rest of her life. Not everyone feels the same, one size doesn't fit all so if a young girl in those circumstances has a choice and talks it over with her family, I'm OK with that. Mississippi led the way in helping to return our nation to the idea of state's rights and for that reason, today I am a proud Mississipian!!

Rape alwsy enters the argument when discussing abortion. I completely understand the scenario you describe, however, there is a pill that you can take to prevent pregnancy if you seek medical attention within 5 days of having sex. Yes-that's right-5 days (it works best if taken as soon as possible). Abortion is being used as birth control and it should never have been

This pill is not 100% effective, so if someone takes this pill and is still pregnant in this situation, they should have recourse. Also, why do we want people dumb enough to use abortion as birth control breeding? Don’t we have enough low impulse control idiots?

Expand full comment

But people ARE using abortion as birth control. It really comes down to personal responsibility. So my take on your comment is that there should be a way to control whether or not someone who you consider a "low impulse control idiot" should not be able to reproduce? No one person or group of people should ever be able to make decisions like that. It is a slippery slope to go down. China is a prime example of that. They limited births to one baby per couple so baby girls were aborted. Now the population is unbalanced in China.

Expand full comment

YOU banning it IS making a decision…at least if the decision is made, let it be theirs.

Again, if someone is too dumb to figure out less extreme forms of birth control, and doesn’t want to breed, you saying that they have to IS you or a group of people making that decision. You and that group of people wanting to make said decision aren’t even making an especially good one by making these people breed FFS.

China is what happens when you do communism and destroy your culture. This is what the WEF types want for everybody, even going so far as to have major corporations pay for abortion vacations and likely soon, sterilization as well. Because that’s what these “people” do, is push. Only upside I see there is maybe more bugpeople moving out of red states, but more idiots breeding (and needing social services) may cancel out said benefit

It hasn't been banned and I didn't do it. All the ruling by the SC does it give the power back to the states. You appear to be unhinged. Get a grip.

My problem with all this is that one’s who are most upset about today’s abortion ruling are the ones who want us to regard January 6th as a frontal attack on our democratic principles (we’re actually a constitutional republic BTW but details, details...)...

So a court ruling that says it’s up to the citizens of each State (through the power of self-determination) to either allow abortions or not is inconsistent with a “democratic” process...???

How is that not a frontal attack on core of democratic principles?

WTF....!!!???

Marvelous commentary, as always. I knew there was a reason why I was compelled to subscribe to TechnoFog. Admittedly (as a woman and native Californian) I have been largely ambivalent on the abortion issue. Now I’m in TX and as time marches on, so does the tyrannical Left - demanding more and more latitude to end life at any stage - why not offer elderly euthanasia as an abortion service too? Abortion is already being used as expedient birth control, which is aberrant. I damn-near strangled at Northem’s obvious intent to allow a pesky surviving entity to expire torturously on a metal table after birth, or worse. The ghoulish, celebratory grins of Cuomo’s NYC supporters as he signed the law for late (late, LATE) term abortions swung me into negative territory. I don’t see the point in Roe v Wade when there are states rights. The Feds don’t HAVE to pass a law. States like CA and NY that want to turn themselves into abortion tourist attractions aren’t prohibited from doing so. Gavin Newsom will offer 3 days/2 nights “ Abortion Special “ package tours - 1st day Disneyland in Anaheim, 2nd day abortion in Hollywood, Venice Beach on the 3rd day. Or, conversely the same premise at Coney Island. If late term abortion means so much to a person, commit to the location and move to a place that offers it. Those services don’t need to be mandatory in every state, whether voters agree or not. I know ethics & morals annoy the Left but the Left annoys Libertarians who HAVE ethics & morals and they may as well get over themselves. Pelosi’s opinion isn’t sacrosanct. Abortion isn’t mentioned in the Constitution. Roe v Wade should never have been passed.

Thanks for saying that. Been thinking of what comes next... and how far the most liberal states will go.

Expand full comment

How about the other direction? Would it pass constitutional muster for a state that bans abortion to also make it illegal to cross the state line to have an abortion?

I can't drive into a neighboring state and buy a gun that's illegal in my state and bring it back in. Not a perfect analogy but good enough to make the point.

This mirrors what I just wrote. I am the same, woman from California who moved to a state that was more of a fit for me, almost 20 years ago. As both you and I have done, one is free to move to a state with aligned values. They have pushed too far, on too many issues. If it could be done, I often think the only way out is national divorce. They have this seemingly incessant need to get in everyone’s face and force them to think, do and be what they want. I hate their drama and simply want to be left alone. And for the children to be left alone.
