The Biden Administration calls Trump and his supporters an existential threat to America. If they believe what they’re saying, then they must be on the path to indicting former President Donald Trump.

Then there’s the alternative theory: that the Biden Department of Justice is doing everything it can to damage Trump politically just short of indictment.

Both theories rely on the politics of the investigation into Trump. Democrats certainly see benefits with either course of action, both currently and in the 2024 election. But before we get to that, let’s focus on the alleged obstruction of justice, the weaknesses of the public record, and how the mistakes of a Trump lawyer have complicated matters.
